I oversee a team dedicated to providing practical, solution-oriented legal advice regarding traditional labor and employee relations matters for Southern Glazer's in 45 states and Canada. My team manages the Company's employment litigation with a goal towards efficient resolution of disputes. We also provide day-to-day advice regarding matters relating to employment discrimination/harassment/retaliation, wage and hour issues, whistle-blower claims, trade secret protection and other employee relations matters. Additionally, I oversee a team of trained investigators dedicated to investigating and resolving allegations of discrimination, harassment and retaliation, and we provide nation-wide training on these topics to avoid
such claims. We represent the company in charges before federal and state administrative agencies, and we manage litigation brought by employees. Our team also oversees traditional labor matters relating to the Company's 27 collective bargaining agreements. We participate in collective bargaining, advise regarding CBA drafting and interpretation, manage grievances and arbitrations, and represent the Company before the National Labor Relations Board. Finally, we also manage the Company's affirmative action plans and OFCCP compliance.

In addition to my legal work, I also co-chair the Dallas corporate office's diversity council. The Council is dedicated to promoting diversity at Southern Glazer's and ensuring that employees of all backgrounds are included in all aspects of our business. As part of this effort, the Council also oversees the Company's business resource groups and encourages cooperation between them.

My practice was focused on defending employers in a broad range of employment litigation matters in both federal and state court, as well as in administrative proceedings. I have extensive experience representing clients in all forms of discrimination, harassment, and retaliation litigation. I also have extensive experience representing both employers and executives

in litigation surrounding executives joining a former employer's competitor, including litigation regarding electronic theft of confidential information and trade secrets. Finally, I also regularly represented employers in collective action wage and hour litigation. In addition to employment work, I also represented employers in a range of traditional labor matters, including achieving grievance denials for employers in arbitration (both under the NLRA and the RLA). Finally, I also regularly represented clients before the Equal Employment Opportunity Commission and the Texas Workforce Commission in discrimination, harassment, retaliation and wage and hour administrative investigations. In particular, I regularly represent employers in DOL and TWC audits and investigations.

My non-litigation practice included advising and counseling employers
about legal compliance and risk management relating to employment and human resource issues. In doing this, I provided preventive services such
as investigating claims of harassment pre-litigation, preparing executive employment agreements, preparing non-solicitation and non-competition agreements, drafting employee handbooks, and provide advice regarding employee discipline and termination, reductions in force, leaves of absence, hiring and promotion practices, drug testing, workplace violence and protection of confidential information.

With 35-plus years of first-in-class professional experience spanning every aspect of the hospitality, tobacco, and beverage industries, the innovative entrepreneur and tastemaker Tim Haughinberry formed Back Bar USA. In developing the full-service consulting and marketing agency Back Bar USA, Tim brings to the table his unparalleled vision and expertise in brand strategy, growth, and innovation as CEO and head of consulting at the company.

Tim got his start in Las Vegas, Nevada, and has been active in all parts of the business life cycle. His education and management career began during his hospitality studies at the University of Nevada, Las Vegas. He then took on his first key role with Southern Wine & Spirits (now Southern Glazer’s Wine & Spirits), rising quickly as a young executive. Tim traded spirits for cigars in 2000 when he accepted a position as vice president of on-premises distribution with Consolidated Cigar Corporation (now Altadis USA).

During his time at Altadis, Tim completely revolutionized the distribution channel for premium cigars internationally, leading to a historic increase in sales. Working closely with the well-known cigar brand Montecristo, ideas became reality and Tim left the company owning the brand’s trademark for alcohol licensing. Capitalizing on his experience and relationships, Tim developed the ultra-premium and internationally recognized Montecristo Rum. Montecristo received multiple awards, including a double gold medal at the 2003 San Francisco World Spirits Competition. Most importantly, it gave Tim international sales experience from ideation to distribution and marketing. In 2008, Back Bar USA was born and grew to become a Top 5 company in beverage consulting and strategy, and continually evolves alone with the dynamic industry.

The mission of Back Bar USA is to offer services that further develop brand marketing and growth within the beverage and hospitality industries. As an LGBTQ-owned business, Back Bar USA continues Tim’s mission to put advocacy at the forefront by thoughtfully championing other diverse-owned brands, products, and services. Tim is himself a member of the LGBTQ community, serving as president of The Gay and Lesbian Chamber of Commerce Nevada (GLCCNV), which supports LGBTQ business owners by encouraging federal, state, and local implementation of pro-business, LGBTQ-inclusive policies. He also serves as a board member for The Center LV, who’s mission is to serve as a haven for all, welcoming and celebrating diversity and empowering the LGBTQIA+ community to live authentic lives. Tim has continued to support Nevada businesses by accepting a position on Nevada’s Commission on Tourism Recovery Committee, which aims to safely bring tourism back to the state.

Tim and Back Bar USA are also involved locally with the UNLV Alumni Association and have supported the future business leaders of Las Vegas with the Back Bar USA Scholarship Program for students in the UNLV Hospitality Management Program.
